Age Restrictions
ALL WINE ORDERS MUST BE PLACED BY A PERSON 21 YEARS OF AGE OR OLDER. By using this site you swear and affirm that you are over the age of 21. WineSavage.com makes every effort to ensure that alcoholic beverages are not delivered to anyone who is under the age of 21. By using this site you are acknowledging that the person receiving a shipment of alcoholic beverages from WineSavage.com is over the age of 21. Verification of age is required at the time of delivery.  Failure to produce age verification forfeits the right to receive the shipment until identification is produced. Customer comments on their order such as "Please leave on back porch" or "Please leave at front door" will be ignored!

It is recommended that you have your wine shipped to a work address, or one where an adult will be available to sign for your shipment. In the event that no one is available to receive the shipment after three delivery attempts, UPS will return the shipment to the sender and you will be charged a shipping return fee of $25. If at that time you wish to have the wine re-shipped, you will be billed again for the cost of shipping the wine. 

If you do not agree with these conditions of use please do not use this site. If you intentionally or unintentionally misrepresent your age in order to provide alcohol to a person under the age of 21 WineSavage.com may prosecute you fully to the extent allowable by law.

Title and Ownership
Title to, and ownership of, all wine passes from WineSavage to the you at our warehouse in California and you take all responsibility for the shipping from the warehouse to your home state. By placing an order, you authorize WineSavage to provide a service to you, acting on your behalf to engage a common carrier (i.e., UPS, FedEx) to deliver your order where you want it delivered. By utilizing this service from WineSavage, you are representing that you are acting in a fashion compliant with your local and state laws regarding the purchase, transportation and delivery of wine. We make no representation to the legal rights of anyone to ship or import any wines into any state. You represent that you have obtained any required permission, paid any required fees, are working through properly licensed intermediaries where required, are legally entitled to take possession of wine, are legally entitled to take quantities ordered and once again authorize that you are 21 years of age. You are solely responsible for the shipment of your wine and for determining the legality and the tax/duty consequences of having your wine shipped to you. Once wine has left our storage facility, you are solely responsible for any loss or damage.

THIS SITE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. NO REPRESENTATIONS OR WARRANTIES OF ANY KIND ARE MADE, EXPRESS OR IMPLIED, AS TO THE OPERATION OF THIS site OR THE INFORMATION, CONTENT, MATERIALS, OR PRODUCTS INCLUDED ON THIS SITE. User Obligations
You agree not to do any of the following while using the WineSavage.com site:

• Intentionally or unintentionally violate any applicable law or regulation.
• Access, tamper with, or use nonpublic areas of the WineSavage.com site or WineSavage.com computer systems.
• Unauthorized individuals attempting to access or tamper with these areas may be subject to prosecution.
• Frame or link to the WineSavage.com site except as permitted in writing by WineSavage.com.

Cancellations Policy
Most orders ship by the next business day. Should you wish to cancel an order you may do so however all cancelled orders are subject to a 25% restocking fee. This includes orders that customers have requested to be held in our warehouse for future shipment.

If your order has already shipped but has not yet been received, shipping charges will not be refunded. Please contact Customer Service at mywine at winesavage.com. If it has already shipped you will be asked to refuse the order when it arrives and when the merchandise is received back at our warehouse you will be refunded for the purchase price and sales tax less the restocking fee.

Our Return Policy
If you are not completely satisfied with your purchase, please contact Customer Service within 30 days of receipt of your purchase at mywine at winesavage.com.  We allow products to be returned only if the product is defective. 

WineSavage.com cannot guarantee the condition of any wine if the wine is not received the first time FEDEX or UPS delivers. If there is no one home to sign for it, the wine may get held in a FEDEX or UPS facility that is not temperature controlled. By California State Law return of alcohol products can only be for exchange of the identical product or for store credit.  There is no cash, check or credit card refunds under any circumstances.

We ask that you retain the original shipping boxes and inserts in order to facilitate any return shipments. We reserve the right at our sole discretion to determine whether or not products are defective.   Empty bottles of wine are never considered defective product.

Third Party Content and Monitoring
Any opinions, advice, statements, services, offers, events or other information or content expressed or made available on this WineSavage.com site by third parties (including information providers and users) are those of the respective author(s) or distributor(s) and not of WineSavage.com.  WineSavage.com neither endorses nor is responsible for the accuracy or reliability of any opinion, advice, information, or statement made on this WineSavage.com site by anyone other than authorized WineSavage.com employees acting in their official capacities.

Parental Control Protections
As required by the Communications Decency Act of 1996, WineSavage.com hereby notifies you that parental control protections (such as computer hardware, software, or filtering services) are commercially available that may assist you in limiting access to content that may be harmful to minors. Among the many companies that provide Internet blocking and screening software are CyberPatrol, NetNanny, SurfWatch, and GuardOne. WineSavage.com does not sponsor or endorse any of these companies or their services.

The WineSavage.com site may contain links to other web sites or resources. You acknowledge and agree that WineSavage.com is not responsible or liable for (1) the availability or accuracy of such web sites or resources; or (2) the content, advertising, or products on or available from such web sites or resources. No Responsibility to Sell Mispriced Products or Services
WineSavage.com shall have the right to refuse or cancel any orders placed for products and/or services listed at an incorrect price, rebate or refund, or containing any other incorrect information or typographical errors. WineSavage.com shall have the right to refuse or cancel any such orders whether or not the order has been confirmed and your credit card charged. If your credit card has already been charged for the purchase and your order is canceled, WineSavage.com shall immediately issue a credit to your credit card account in the amount of the charge or offer a store credit.

 

WineSavage.com reserves the right to change these terms and conditions from time to time in its discretion.
